Order of Nondisclosure

Order of Nondisclosure in Fort Worth

Prohibit Disclosure of Your Misdemeanor or Felony

An "Order of Nondisclosure" is a legal procedure through which, under certain circumstances, your misdemeanor or felony can be placed under a court order that prohibits government agencies from disclosing the existence of your case.

In most misdemeanor cases, you can petition the court for an order of nondisclosure immediately after the successful completion of your probation. Cases such of the following are open for orders of nondisclosure:

  • Unlawful transport or restraint
  • Indecent exposure or public lewdness
  • Assault
  • Domestic offenses
  • Riot
  • Highway obstruction
  • Weapons offenses
  • Animal abuse

For felony cases, you must wait ten years after completing your probation before petitioning the court for an order of nondisclosure. The following offenses cannot be sealed:

  • Any offense requiring sex offender registration
  • Aggravated kidnapping
  • Murder
  • Causing injury to an elder, disabled, or underage person
  • Abandoning or endangering a child
  • Stalking
  • Violating protective order

It is important to hire a knowledgeable and experienced attorney like Lesa Pamplin to review your case and help you file the order of nondisclosure if it is applicable to you. Even if your case has been dismissed, anyone who checks your criminal history, including potential employers, will be able to see your record and your plea. Not only will your record be available to check, but agencies such as the District Attorney's Office, Police Department, Sheriff's Office, Jail, and FBI will have a copy of your files.
